Privacy Policy

Helm is committed to balancing the need to protect your personal data while at the same time providing you with access to the best possible interactive security, home automation and video products and services. This Privacy Policy (effective November 1, 2019) summarizes our collection and use of your information that you provide when using (i) this website and (ii) any combination of products and services which can be purchased or accessed on this website (the “Combined Services”). It is important that you review this Privacy Policy carefully.

I. Collecting and Using your Information

Helm collects and stores certain information from or about you that can be used to uniquely contact, identify, or locate you (“Non-sensitive Personally Identifiable Information” or “Non-sensitive PII”). When using our site or the Combined Services, you may provide us with Non-sensitive PII including, but not limited to, your name, home or business address, phone number, email address, location, or zip code. When you use the Combined Services, you may provide certain additional information to our service providers (e.g., home or business size, home or business system configuration, login or access credentials, sensor names, devices, account information, schedule, mode, automation settings, and device settings) in order for us to coordinate any installation or to personalize your Combined Services. Helm may also receive information that you provide to our partners, including emergency contact information and user profile information, enabling Helm to coordinate provision of the Combined Services.
Information regarding your use of the Combined Services may also be collected by our service providers, including but not limited to: performance of any security or other device, electrical usage or consumption, heating and cooling information, light or other fixture settings, and usage and alert logs. This type of information is received from your devices and your computer or other electronic device through which you may access, browse, download, receive, or otherwise use the Combined Services (“Personal Devices”).

II. Links, Combined Services and Off-Line Information

Helm offers products and services from other companies and its website contains links to websites not operated by Helm. Helm is not responsible for the privacy practices of third parties. If you purchase such products and services and/or visit these third party sites, you should check their applicable privacy policies to determine how they treat user information. Helm strives to protect your information off-line as well. We restrict access to information to those employees who need to process your account such as a customer service representative or financial personnel.

III. Location-based Information

Some features of the Combined Services use location-based information to enable geo-fencing capabilities (e.g., to send arming reminders or adjust the thermostat when you are a designated distance from home). When you opt-in to activate these geo-fencing services, location information will automatically be collected and stored by our service providers from your Personal Device or vehicle you designate which is capable of producing location data (e.g., mobile or GPS device). This location information may include your current location or places you recently visited and may be aggregated for a contractor’s internal purposes only. Do not enable geo-fencing features if you do not want location-based information to be collected by our service providers.

IV. Video and Audio Recordings

If you purchase video monitoring or video monitoring services such as Visual Verification, a connected doorbell, camera, image sensor, or other connected device or wearable or subscribe to two-way voice, you may enable our service providers, or your central station, to record, store, view and process video and/or audio recordings from your monitoring equipment. This may include capturing and sending to you portions of this data as part of a notification or analyzing the data to identify motion or other events. This information from your monitoring equipment may be processed so that alerts can be sent to you. In addition, if you have the recording features enabled on these video products or services, video and audio data recordings from your device will be captured, processed, and stored by applicable service providers, and you may be able to access those recordings.

Data protection and privacy laws may impose certain responsibilities on you and your use of security cameras, connected doorbells and other devices with recording capabilities. You alone are responsible for ensuring that you comply with any applicable laws. For example, you may need to display a notice alerting visitors to your home or business that they may be recorded using security cameras and other devices with recording capabilities. Helm takes no responsibility for your compliance with these laws.

V. Sharing Your Information

Helm will not disclose your Non-sensitive PII to any other entity except:
as is necessary to provide the Combined Services to you; to the central station we select to receive alarm signals and coordinate emergency response; when you have opted in to share the information; to enable our service providers to provide the Combined Services (they will have no right to use such Non-sensitive PII beyond what is necessary to assist us); if you are an existing customer, to promote additional Helm-supported products and services to you, either directly or through a third party; as necessary in connection with other business purposes; and as necessary if required or permitted by law to disclose. In addition, we may disclose your information when the information has been converted to a form that cannot be used to identify you. It may also be necessary for us to disclose your Non-sensitive PII in case Helm sells all or part of its business, or is otherwise involved in a merger or transfer of all or a material part of its business, as your information may transfer as part of the transaction to the party or parties involved in the transaction.

VI. Protecting Your Information

Helm uses commercially reasonable administrative, technical, personnel, and physical security measures designed to safeguard Non-sensitive PII in our possession against loss, theft and unauthorized use, disclosure, or modification.
However, no security system is perfect and we cannot guarantee the security of our servers and databases or that the information you submit to us over the Internet will not be intercepted.

VII. Local Storage, Cookies and Web Beacons

Helm may utilize Local Storage, Cookies, and web Beacons to better target our services. Data placed in “Local Storage” is per domain and persists after the browser is closed. “Cookies” are small identifiers sent from a web server that are stored on your computer’s hard drive for the purpose of identifying your browser during interaction on our site. “Web beacons” are invisible electronic images, called a single-pixel (1x1) or clear GIF, which can recognize certain types of information on your computer, such as a cookie number, time and date of a page view, and a description of the page where the web beacon is placed. All of these tools can assist us in collecting data related to your use of our website and help us address technical issues. These tools do not contain any personal data, they do not damage your files, and they do not allow us or anyone else to access your personally identifiable information. These tools may contain such information as an IP address, DNS host name, and/or browser type. Cookies can also identify you on future visits to our site, making navigation easier and allowing you to bypass the process of re-entering certain information each time you access the site.

We may collect information relating to customer trends and patterns and use cookies and software tools to measure site usage and related information.

If you access the Combined Services through your Personal Device, certain information about your Personal Device may be collected such as usage information and statistics, an IP address, Personal Device type and model, browser type, Personal Device ID, domain names, access times, referring website addresses, Personal Device settings and history, and other information collected about your access of the Combined Services or receipt of communications or notifications.

VIII. Changes

From time to time Helm may modify this Privacy Policy, and such modifications shall be effective upon posting by Helm on this website. Your continued use of the Combined Services after Helm posts a revised Privacy Policy signifies your acceptance of the revised Privacy Policy. Therefore, it is important that you review this Privacy Policy regularly to ensure you are updated as to any changes. If Helm materially changes its practices regarding collection or use of your Non-sensitive PII, your Non-sensitive PII will continue to be governed by the Privacy Policy under which it was collected unless you have been provided notice of, and have not objected to, the change. As a customer, you can correct, update or delete your Non-sensitive PII by contacting our Customer Service department at privacy@helmsmarthome.com or contacting our service providers.

We may change this Policy at any time and from time to time. Any changes to this Policy will be posted on our User Interfaces. The most recent version of this Privacy Policy is reflected by the version date located below. This Privacy Policy is not intended to and does not create any contractual or other legal right in or on behalf of any party.

IX. “Do Not Track” Disclosures Required by California and Delaware

California and Delaware law require Helm to indicate whether it honors “Do Not Track” settings in your browser concerning targeted advertising. We may use how you browse and shop in order to show you ads for Helm or our advertising partners that are relevant to your interests. We may use cookies and other information to provide interest-based ads to you which are based on your browsing behavior and are more tailored to your interests. These interest-based ads may be presented to you while you are browsing our site or third-party sites not owned by Helm.

We belong to ad networks that may use your browsing history across participating websites to show you interest-based advertisements on those websites. Our site does not respond to “do not track” signals or similar mechanisms to indicate you do not wish to be tracked or receive interest-based ads.
